The Community Court of Justice, ECOWAS, has adopted the Instructions to the Chief Registrar and Practice Directions (2025) to improve efficiency and procedural integrity across its operations.
These updates, announced Friday, reflect recommendations from the Judicial and Judges’ Retreats held in November 2023. They consolidate and build on the 2012 guidelines and the 2020 Practice Directions on electronic case management, addressing procedural gaps and optimizing case management.
Key Highlights
- Streamlined Case Management: New page limits for applications ensure expediency: Initiating Applications and Statements of Defence (15 pages), Replies and Rejoinders (10 pages), and other applications (5 pages). Documents must follow A4 formatting, Times New Roman font, and font size 12 or higher.
- Monitoring and Compliance: The Chief Registrar will enforce filing deadlines, issue Certificates of Non-lodgement, and delist dormant cases when appropriate.
- Expedited Procedures: Urgent applications and interim measures are prioritized, with translations receiving expedited handling.
- Enhanced Language Accessibility: Interpretation in non-working Court languages is available upon request, with freelance interpreters employed under ECOWAS-approved terms.
- Compensation and Damages: Awards will be issued in the currency of the Respondent State, with conversion based on ECOWAS Bank for Investment and Development exchange rates.
- Preliminary Objections and Consolidation: Clear timelines for objections and case consolidation streamline proceedings.
- Third-Party Interventions: Provisions for amicus curiae and third-party participation promote broader stakeholder engagement.
Issued under Articles 12 and 100 of the Court’s Rules, these guidelines reinforce the Court’s mission to uphold justice, equity, and effective access to legal recourse for citizens across the ECOWAS region.
