Court to rule on ex-AGF Nwabuoku’s no-case submission Nov 13

The Federal High Court sitting in Maitama, Abuja, has reserved ruling till November 13, 2025, on the no-case submission filed by a former Acting Accountant General of the Federation (AGF), Chukwunyere Anamekwe Nwabuoku.

Justice James Omotosho fixed the date after hearing arguments from both the defence and prosecution during Monday’s proceedings.

Nwabuoku is being prosecuted by the Economic and Financial Crimes Commission (EFCC) on an amended nine-count charge bordering on money laundering and diversion of public funds amounting to ₦868,465,000 (Eight Hundred and Sixty-Eight Million, Four Hundred and Sixty-Five Thousand Naira).

Defence counsel, N.I. Quakers, SAN, informed the court of his readiness to adopt the no-case submission earlier filed on behalf of his client, which was duly adopted along with a reply on points of law.

On his part, EFCC counsel, Ekele Iheanacho, SAN, told the court that the Commission had filed two responses to the application and sought to withdraw one filed on July 16, 2025. The request was not opposed by the defence, leading Justice Omotosho to strike out the earlier response.

“The response to the no-case submission filed on July 16, 2025, is hereby struck out,” the judge ruled.

Iheanacho then adopted the EFCC’s valid response dated October 23, 2025, urging the court to dismiss the defendant’s no-case submission.

After listening to both parties, Justice Omotosho adjourned the matter to November 13, 2025, for ruling.
