NHRC condemns police arraignment of minors for treason over #EndBadGovernance protest

The National Human Rights Commission (NHRC) has condemned the arraignment of minors on treason charges following their involvement in the recent #EndBadGovernance protests.

In a statement, NHRC Executive Secretary Dr. Tony Ojukwu criticized the arrests as clear violations of national, regional, and international laws designed to protect children’s rights.

Dr. Ojukwu highlighted that the detention and arraignment of minors, accused of attempting to overthrow a legitimate government, have stirred concern among legal experts, human rights advocates, and the Nigerian public. He emphasized the need for a justice approach that prioritizes the best interests of children, as stipulated by Nigeria’s Child Rights Act, the Administration of Criminal Justice Act, and international treaties like the UN Convention on the Rights of the Child.

The NHRC criticized the stringent bail conditions imposed on these minors, which have reportedly led to prolonged detention, with cases adjourned until January 2025. The Commission noted concerns over the children’s wellbeing, with reports of malnourishment and signs of physical distress.

In response, the Attorney General of the Federation, Prince Lateef Fagbemi, has directed the police to forward the minors’ case files for review by the Director of Public Prosecutions. This move is seen as a positive step towards a fair reassessment of charges and improved protections for minors in conflict with the law.

Dr. Ojukwu urged authorities to ensure a humane approach and uphold the right to peaceful protest, while stressing the importance of prosecutorial and judicial oversight to prevent extreme penalties on minors. The NHRC continues to advocate for reforms within Nigeria’s juvenile justice system to protect children’s rights and uphold fair treatment.
