EFCC arraigns Emefiele for alleged $4.5bn, N2.8bn fraud

The Lagos Zonal Command of the Economic and Financial Crimes Commission (EFCC) presented before Justice R.A. Oshodi of the Special Offences Court, situated in Ikeja, Lagos, on Monday, April 8, 2024, a case concerning alleged financial malfeasance involving a former Governor of the Central Bank of Nigeria, Mr. Godwin Emefiele. Emefiele, alongside co-defendant Mr. Henry Omoile, was arraigned on an amended 26-count charge.

The charges brought against Emefiele span counts one to four and counts eight to 26, which include accusations of abuse of office, receipt of gratification, corrupt demands, fraudulent receipt of property, and conferring corrupt advantage. These alleged actions are contrary to and punishable under relevant sections of the Criminal Law of Lagos 2011 and the Corrupt Practices and Other Related Offences Act 2000. Omoile, on the other hand, faces charges outlined in counts five, six, and seven, related to the acceptance of gifts by agents, as stipulated by Section 65 of the Criminal Law of Lagos State 2015.

Both defendants entered a plea of “not guilty” to all charges leveled against them. Prosecution counsel, Rotimi Oyedepo, SAN, emphasized that their plea signals readiness for trial and requested an expedited hearing, along with the opportunity to present witnesses to substantiate the prosecution’s case.

Defense counsel, A. Labi-Lawal, informed the court of bail applications filed on behalf of the defendants, which had been served to the prosecution. Arguing for Emefiele’s bail, Labi-Lawal urged the court to consider granting bail either on self-recognizance or on favorable terms pending trial, citing Emefiele’s compliance with previous bail conditions set by another court.

Regarding Omoile, Labi-Lawal similarly petitioned for bail on lenient terms pending trial. In response, Oyedepo stressed the court’s discretion in granting bail and requested conditions that would ensure the defendants’ appearance throughout the trial.

Justice Oshodi scheduled a ruling on the bail applications and trial proceedings for April 11, 2024. Pending the ruling, he ordered Emefiele’s remand in EFCC custody and Omoile’s detention at the Ikoyi Correctional Centre.
