In a recent legal development, Justice I.O. Ijelu of the Special Offences Court in Ikeja, Lagos, has pronounced a significant verdict, sentencing Anana Keneth Emeka to 16 years of incarceration.
The conviction was a result of his involvement in computer-related fraud activities. This case comes as part of an ongoing investigation into the intricate operations of a notorious criminal network known as the “catcher,” led by Osondu Victor Igwilo, who was apprehended by operatives of the Economic and Financial Crimes Commission (EFCC) on March 11, 2022, after having been under the watchful eye of the Federal Bureau of Investigation (FBI) since 2018.
Emeka was initially charged with three counts on June 7, 2022, and was subsequently re-arraigned on December 28, 2022, on eight amended charges. These charges encompassed the possession of fraudulent documents, forgery, providing false information, and impersonation.
Count one of the charges states, “Ajana Kenneth Emeka, sometime in 2022 in Lagos, within the jurisdiction of this Honourable Court, with intent to defraud, had in your possession fraudulent documents titled ‘THE PALESTINIAN AUTHORITY’ in the name of ‘HANY A.O. SALMAN HALIMA,’ which representation was printed from your phone, representation you knew or ought to have known to be fraudulent.”
Count two reads, “Ajana Kenneth Emeka, sometime in 2022 in Lagos, within the jurisdiction of this Honourable Court, with intent to defraud, had in your possession fraudulent documents wherein you falsely represented yourself as ‘Christopher Dods Named’ to unsuspecting members of the public, which representation was printed from your phone, representation you knew or ought to have known to be fraudulent.”
Count three alleges, “Ajana Kenneth Emeka, sometime in 2018 in Lagos within the jurisdiction of this Honourable Court, with intent to defraud, knowingly forged a document titled ‘FEDERAL REPUBLIC OF NIGERIA NATIONAL DRIVERS LICENCE’ with L/N APP40679AA79 issued in the name of EMEKA NWAGU, which you purported to have been issued by the Federal Road Safety Commission.”
Despite the charges, Emeka pleaded “not guilty” to all of them. Throughout the course of the trial, the prosecution presented a range of witnesses, including an FBI representative, EFCC investigation officers, and an EFCC forensic expert who conducted a thorough analysis of the defendant’s mobile device. The prosecution also submitted several documents into evidence, which were admitted by the court.
However, during the process of tendering the extra-judicial statement of the defendant, the defense counsel, C. Obieze, SAN, raised objections regarding the statement’s voluntariness. Consequently, the Judge ordered a trial-within-trial, and the extra-judicial statement was eventually admitted into evidence.
Once the prosecution had concluded its case, the defendant took the stand to defend himself and vehemently denied all charges against him.
On October 3, 2023, Justice Ijelu delivered the verdict, asserting that the prosecution had successfully established Emeka’s guilt beyond reasonable doubt on all eight counts. As a result, he was declared guilty as charged on all counts.
Emeka received a two-year sentence for each of counts one to three, with the option of a fine amounting to N250,000. He was also sentenced to two years for count four, with the possibility of a fine totaling N300,000, and two years for count five, with an option of a N250,000 fine. Similarly, he received a two-year sentence for count six, with an alternative N250,000 fine, as well as two years for each of counts seven and eight, with the possibility of a N300,000 fine. The fines must be paid within 30 days; otherwise, the defendant will serve the corresponding prison terms.
In addition to the prison sentence, the Judge ruled for the forfeiture of Emeka’s possessions and property, which include a Samsung Galaxy mobile device and his residence located at 567, Road 21, Mayfair Garden Estate, Awoyaya, Lagos, to be handed over to the Federal Government of Nigeria on behalf of his victims.
